
Amazon’s Response
In its 2023 motion to dismiss the lawsuit, Amazon argued that the FTC misrepresented its design choices and claimed that its processes complied fully with existing laws. According to the company, Prime members have always had “multiple simple mechanisms to cancel.”
While the settlement does not require Amazon to admit fault, agreeing to a $2.5 billion financial penalty and to redesign enrollment interfaces indicates significant acknowledgment that improvements were necessary.
Amazon has now committed to:
- Simplifying sign-up and cancellation flows
- Using clearer, more direct language
- Disclosing auto-renewal terms more prominently
- Eliminating unnecessarily complex obstacles
Refunds will be distributed to consumers who meet eligibility requirements. While payments will vary, individual refunds are expected to be capped at $51 per person. The exact amount each claimant receives depends on how many Prime benefits they used, such as:
- Free shipping
- Prime Video streaming
- Digital downloads
- Exclusive Prime discounts
Those who used fewer than 10 benefits during any 12-month period of membership may receive higher payouts than frequent users.
